Terms & Conditions — Kathya

1. Acceptance of These Terms

By accessing or using Kathya (available at kathya.ai and its subdomains, together the "Service"), you agree to these Terms & Conditions ("Terms"). If you don't agree, please don't use the Service.

2. Who We Are

Kathya is operated by Rakesh Mulchandani, an individual based in India, currently operating as a sole proprietor (not yet a registered company).

3. Description of the Service

Kathya is a Hindi-first, AI-powered creator toolkit offering, among other things:

• English-to-Hindi and Hindi-to-English text translation
• Script upload and translation
• SRT subtitle translation
• AI script generation
• AI avatar video generation, including voice cloning and custom avatars
• AI scene/story video generation
• Short-form video clipping tools

Features and their availability may change as the Service develops.

4. Eligibility

You must be at least 18 years old to use this Service. By using Kathya, you confirm that you meet this requirement.

5. Accounts

You create an account by signing in with your Google account. You agree to:

• Keep your account secure and not share access to it with others
• Notify us if you believe your account has been compromised

We may suspend or terminate accounts at our discretion, particularly in cases of misuse (see Section 8).

6. Credits and Payments

• The Service uses a virtual credit system. Certain actions (translation, script generation, video generation, etc.) consume credits from your balance.
• Credits are not currently purchasable with real money. During this initial period, credits are provided free of charge to users on the free plan.
• Credits are non-refundable once consumed by a completed action, except where required by law or at our sole discretion.
• We reserve the right to change credit costs for any action, and to change how credits may be granted, with reasonable notice where practical.
• If and when Kathya introduces paid credit purchases in the future, this section will be updated with a specific refund and cancellation policy consistent with Indian consumer protection e-commerce rules before payments go live.

7. Your Content and Ownership

• You retain ownership of the text, scripts, photos, voice recordings, and other content you submit to the Service ("Your Input"), and of the outputs the Service generates for you based on Your Input ("Your Output").
• By submitting Your Input, you grant us a limited license to process it (including sending it to third-party AI processors, as described in our Privacy Policy) solely to provide the Service to you.
• You are responsible for ensuring you have the necessary rights to submit any content you provide — including, importantly, the right to use any voice you ask us to clone or any face you ask us to turn into an avatar. Do not submit another real person's voice or likeness without their clear consent.

8. Acceptable Use

You agree not to use Kathya to:

• Create content that impersonates a real person (via cloned voice or avatar) without their consent
• Generate defamatory, harassing, hateful, or discriminatory content
• Generate content that infringes someone else's intellectual property rights
• Generate sexually explicit content involving real or fictional minors, or any content otherwise prohibited by Indian law
• Attempt to circumvent the credit system, access controls, or otherwise abuse the Service
• Use the Service for any unlawful purpose

We reserve the right to suspend or terminate access for anyone who violates these terms, without refund of unused credits where the violation is the cause.

9. AI-Generated Content — What to Expect

Kathya's outputs are generated by AI models and are provided "as is." You understand and agree that:

• AI-generated translations, scripts, voices, and videos may contain errors, inaccuracies, or unexpected results, and should be reviewed before you rely on or publish them
• We do not guarantee that any specific generation will succeed, meet your expectations, or be free of defects
• Where a generation fails after a paid provider action has already occurred, credits for that attempt are still deducted, consistent with the real cost incurred (see our credit system for detail)

10. Intellectual Property

The Kathya name, logo, and branding are the property of Rakesh Mulchandani. Nothing in these Terms grants you rights to our trademarks or branding except as necessary to use the Service normally.

11. Third-Party Services

Kathya relies on third-party AI service providers to deliver certain features (see our Privacy Policy for the categories of processing involved). We are not responsible for outages, errors, or changes in these third-party services that may affect Kathya's availability or output quality.

12. Disclaimers and Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" and "as available," without warranties of any kind, express or implied.
• We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service.
• Our total liability to you for any claim arising from the Service is limited to the amount you paid us (if any) in the 6 months preceding the claim.

13. Indemnification

You agree to indemnify and hold Rakesh Mulchandani harmless from any claims, damages, or expenses arising from your misuse of the Service or violation of these Terms, including content you generate that infringes someone else's rights.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, particularly in cases of Terms violations. You may stop using the Service at any time.

15. Changes to These Terms

We may update these Terms as the Service evolves. We'll update the "Last updated" date above, and for material changes, we'll make a reasonable effort to notify active users.

16. Governing Law and Disputes

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the Service will be subject to the jurisdiction of the courts in Bilaspur, Chhattisgarh.
